Expungement Unit

The Expungement Unit's primary responsibility is to receive and process Request for Expungement (AOC-CR-237) forms and Court Ordered Expungements. This Unit ensures that every Request for Expungement and Court Ordered Expungement meets the legal criteria set by the North Carolina General Statutes: NCGS 15A-145, 15A-146, 15A-147, 90-96, and 90.113. This Unit does inquiries into the Computerized Criminal History Files (CCH), the National Crime Information Center (NCIC), and the Administrative Office of the Courts (AOC). If there are any legal issues found, this Unit researches these issues by contacting the attorney, Presiding Judge, clerk of court or the appropriate out-of-state agency. Once all processes have been completed, this Unit deletes or expunges the criminal history record information denoted by the court order from the CCH computer system, the FBI's computerized criminal history files, the Imaging System, the NIST Archive database and has the record removed from the Automated Fingerprint Identification System (AFIS).
